Qualifications

 

GENERAL DESCRIPTION

Performs highly complex (senior level) legal assistant work to support Staff Attorneys responsible for enforcement litigation. Duties include analysis of investigative reports and managing legal/administrative support for SOAH hearing processes, including knowledge of SOAH rules, filing process and deadlines. May assist with training and oversight of administrative staff. At the direction of staff attorneys is responsible for preliminary preparation of SOAH case evidence. Assists with investigative process for SOAH cases including processing subpoenas, obtaining certified records from courts and other public entities, obtaining, verifying, and organizing affidavits and working with non-retained witnesses to obtain sworn statements and affidavits on SOAH cases. Reports to the Legal Assistant Supervisor and Director of Litigation and works under limited supervision with considerable latitude for the use of initiative and independent judgment.

PRINCIPAL JOB DUTIES AND RESPONSIBILITIES

100% 

·       May attend proceedings and assist staff attorneys with presentation of evidence.

·       May work with the investigations department to obtain prescription data for licenses.

·        For SOAH cases, will assist with case tracking, organization of pleadings and discovery and maintain litigation files electronically.

·       Works with administrative staff to maintain the agency file and verify evidence returned from SOAH.

·       Assists with preparation of evidence for review by expert witnesses.

·       Assists with evidence organization, witness coordination, certification of documents, affidavits and sworn statements in temporary suspension and cease and desist cases.  

EXPERIENCE AND EDUCATION

•          Graduation from standard senior high school or equivalent is required.

•          Certificate of graduation from a course of study as a Legal Assistant/Paralegal and/or graduation from an accredited four-year college or university with major course work in law or a related field is preferred.

•          Experience in legal assistant/paralegal work is required.

•          Must be in good performance standing in the agency and in your department. (For Internal Applicants Only)

•          Experience handling SOAH matters is preferred.

•          Must be proficient in Microsoft software (Word, Excel, E-Mail), SharePoint, and Teams. 

KNOWLEDGE, SKILLS, AND ABILITIES

•          Knowledge of legal terminology, or research methods, and techniques; and of administrative and court procedures

•          Knowledge of office practices and procedures

•          Skills in word processing and other standard office equipment

•          Skills in management of filing systems to assure accurate and rapid storage and retrieval of case documents.

WORK ENVIRONMENT REQUIREMENTS

•          If remote or hybrid work schedule applicant must have a dedicated, quiet, and secure workspace that ensures privacy and minimal distractions to maintain confidentiality while working remotely.

•          If remote or hybrid work, an applicant must have reliable and secure high-speed internet access with a minimum of 20 MBPS download and 2 MBPS upload.  Applicants may be required to provide confirmation from the area ISP.

•          All applicants must be familiar with or have a willingness to learn Microsoft suite (e.g. Word, PowerPoint, SharePoint, Excel, and Microsoft Teams).

•          All applicants assigned to an agency issued device (e.g. laptops, IPADS, cell phones) must use the agency device assigned to them to conduct agency business.  The use of personal devices to perform official work responsibilities is not permitted unless formally approved.

PHYSICAL REQUIREMENTS AND/OR WORKING CONDITIONS

The principal job is performed in a standard office or remote environment and requires:

•          All applicants must be available to work Monday-Friday during standard business hours in the central time zone (CT), regardless of their physical location and have regular and punctual attendance.

•          All applicants will have prolonged periods of sitting and extensive computer screen time due to computer use.

•          All applicants will have frequent use of keyboard, mouse, and other input devices.

•          All applicants need to have the ability to participate in video calls, phone calls, and virtual meetings.

•          All applicants may experience frequently working under deadlines, individually or as a team member, and at times may collaborate with others to meet deadlines.

•          All applicants may generally experience low physical demands, occasional lifting of equipment up to a certain weight (e.g. 10-40 lbs.). 

LEGAL REQUIREMENTS

•          Cannot hold outside employment that interferes with assigned work schedule, nor does it constitute a conflict of interest with TMB employment and services.

•          Must reside in Texas and within commuting distance of the Austin office.

•          Dual employment at another state agency or Texas public university is not permitted.

•          A DPS background check will be conducted.

•          If hired, must provide documentation(s) within three days of hire that establishes identity and employment verification.

•          Compliance with all agency policies and procedures, including but not limited to applicable confidentiality, security and safety rules, regulations and standards.
